Before and after Photographs – What to do if your client/patient refuses?

The insured shall ensure that photographs are taken of the patient capturing the patient’s treatment area prior to treatment. The insured shall retain these photographs with the patient’s records for a period of ten years after the date of the treatment.  

If a patient refuses to have photographs taken, the patient’s refusal must be obtained in writing from the patient at the relevant time. The patient must sign and date the written declaration of their refusal to allow photographs to be taken and this should be retained by the insured for ten years after the date of the treatment.

This Section Condition only applies in respect of:

(a) botulinum toxin and dermal filler treatments to the head and neck;

(b) all treatments involving the use of laser, but not including genital treatments.

If your client / patient refuses to have their photographs taken and refuses their written declaration of this refusal, then do not carry out the treatment.  If a client is that uncooperative, there is a high likelihood that there will be issues arising post-treatment.  It is not worth taking the risk.

The following Specific Policy Conditions are, in the main, self-explanatory and state what is required of you in certain treatment circumstances.  Despite these conditions being outlined in the policy, and deal with practices that formed part of your professional training, we have seen claims where one or more of the conditions have not been complied with.

To avoid the additional stress of having a claim made against you where you have not complied with policy conditions, we highly recommend you take the time to read the policy wording.  Good risk management is all about prevention and mitigation.  If you are not sure about the requirements of your insurer, please contact us to clarify these policy conditions prior to carrying out any treatment.
